Step one

The Power of Attorney, and its three-stage validation

Definition

A Power of Attorney is a legal document authorising a named representative — family member, trusted person or professional — to act on your behalf for specified purposes, including signing construction contracts, engaging professionals and dealing with government authorities.

For use in India, an NRI’s POA must clear three separate stages, and failure at any one of them invalidates the document entirely:

  1. Notarised in your country of residenceExecuted and notarised locally, wherever you are based.
  2. Apostilled or consular-attestedApostilled for Hague Convention member countries, or attested by the Indian Embassy or Consulate otherwise. The Ministry of External Affairs provides the Apostille process for eligible countries.
  3. Registered at the Sub-Registrar’s office in IndiaThe final step, and the one most often assumed to be optional. It is not.

Check the scope clause, not just the signature. A POA that authorises property dealings in general terms may not cover signing a construction contract or authorising payments — and the gap only surfaces at the moment your representative needs to sign something. Specify construction contract execution and payment authority explicitly when drafting.

Patta mutation is the one that stops the whole project. If you bought the plot but have not completed Patta mutation to your name at the Tahsildar’s office, the building plan application will be rejected — the Patta must match the applicant’s name. Initiate mutation from overseas through the tnreginet.gov.in portal or via your POA holder; it typically takes 2–4 weeks after application, which is time worth spending before the architect is engaged rather than after.

Step three

Choosing an Architect and Builder from abroad

Five verifications before signing any remote appointment:

  • COA registration number: verify it at coa.gov.in. An unregistered designer cannot file on TNOBPAS. For someone who cannot visit the architect’s office, this check is non-negotiable.
  • Class 3 DSC and an active TNOBPAS account: ask for an application reference number from a recent filing in the same authority zone as your plot.
  • References from NRI clients specifically: request contact details for two or three, because they understand the remote management challenge in a way local clients do not. Ask them directly: did the builder send photographs without being asked? Did costs appear mid-project? Were they reachable when something went wrong?

  • BOQ before appointment: request the BOQ for your project before signing the appointment letter. A builder who produces a full IS-graded BOQ before signing is a builder who can be held to its contents.
