In this guide — 6 sections
Building remotely requires: a registered Power of Attorney for an on-ground representative; verified ownership documents — Patta, Sale Deed, EC; a COA-registered architect with Class 3 DSC for approval filing; a full BOQ-based contract with milestone payments; a named project manager; and milestone photographs at every stage. Without these, distance is the contractor’s advantage rather than yours.
NRI house construction in Chennai is among the most financially significant projects an overseas Indian undertakes. The land is here, the money is abroad, decisions happen across time zones, and the project runs fourteen to eighteen months without weekly visits.
The information asymmetry between you and the builder is the builder’s primary leverage. Every transparent system — the BOQ, the milestone payment schedule, the site photographs, the variation order process, the named supervisor — reduces that asymmetry and shifts accountability back to the professional who is physically present. Read every item in this guide as an asymmetry-reduction measure, because that is what each one is.
The Power of Attorney, and its three-stage validation
A Power of Attorney is a legal document authorising a named representative — family member, trusted person or professional — to act on your behalf for specified purposes, including signing construction contracts, engaging professionals and dealing with government authorities.
For use in India, an NRI’s POA must clear three separate stages, and failure at any one of them invalidates the document entirely:
- Notarised in your country of residenceExecuted and notarised locally, wherever you are based.
- Apostilled or consular-attestedApostilled for Hague Convention member countries, or attested by the Indian Embassy or Consulate otherwise. The Ministry of External Affairs provides the Apostille process for eligible countries.
- Registered at the Sub-Registrar’s office in IndiaThe final step, and the one most often assumed to be optional. It is not.
Check the scope clause, not just the signature. A POA that authorises property dealings in general terms may not cover signing a construction contract or authorising payments — and the gap only surfaces at the moment your representative needs to sign something. Specify construction contract execution and payment authority explicitly when drafting.
The Complete document set
Eight documents
Assemble all of them before the architect filesPatta — current, in your name or the POA holder’s
Required for building plan approval; confirms legal ownership
Sale Deed — registered copy
Architect uses it for survey number and area confirmation in the application
Chitta / A-Register extract
Confirms survey number, extent and land classification
Encumbrance Certificate — last 15 years
Confirms no mortgage, lien or legal dispute on the plot
Approved layout plan, if the plot is in a layout
Shows road width, open space and plot dimensions for setback and FSI confirmation
Power of Attorney — registered
Authorises your named representative to sign construction documents on your behalf
NRI bank account and FEMA compliance
Construction payments from overseas must comply with FEMA, with proper purpose codes
Aadhaar-linked mobile for OTP verification
Required for many Tamil Nadu government portal transactions
Patta mutation is the one that stops the whole project. If you bought the plot but have not completed Patta mutation to your name at the Tahsildar’s office, the building plan application will be rejected — the Patta must match the applicant’s name. Initiate mutation from overseas through the tnreginet.gov.in portal or via your POA holder; it typically takes 2–4 weeks after application, which is time worth spending before the architect is engaged rather than after.
Choosing an Architect and Builder from abroad
Five verifications before signing any remote appointment:
- COA registration number: verify it at coa.gov.in. An unregistered designer cannot file on TNOBPAS. For someone who cannot visit the architect’s office, this check is non-negotiable.
- Class 3 DSC and an active TNOBPAS account: ask for an application reference number from a recent filing in the same authority zone as your plot.
- References from NRI clients specifically: request contact details for two or three, because they understand the remote management challenge in a way local clients do not. Ask them directly: did the builder send photographs without being asked? Did costs appear mid-project? Were they reachable when something went wrong?
- Video walkthrough of a live site: ask for a video call walkthrough of a project currently under construction. How a builder conducts a live site call tells you more about their transparency than any brochure.
- BOQ before appointment: request the BOQ for your project before signing the appointment letter. A builder who produces a full IS-graded BOQ before signing is a builder who can be held to its contents.
How a Builder Runs a Video Walkthrough Tells You More Than Any Brochure
Ask for a walkthrough of a project currently under construction, before you appoint anyone. Willingness, camera steadiness and what they show unprompted are all the signal.
Self-Managing Against professional project management
Nine challenges, and how each one resolves differently depending on whether someone qualified is accountable on the ground:
Professional project management typically costs 3–5% of the construction contract value. The average documented overrun on self-managed remote projects without one runs 15–25% of the original BOQ. The fee pays for itself in the first variation order it prevents — and on those figures, the margin is not close enough to make self-management a saving.
What Good Remote Tracking actually looks like
Milestone photography protocol
GPS-tagged, timestamped photographs at every stage: post-excavation depth, foundation reinforcement before pour, slab steel before pour, MEP conduit before plastering, waterproofing before tiling, and the pre-handover walkthrough. Each accompanied by a brief message confirming what was photographed and which stage completed.
Monthly video call
Scheduled with the project manager, not the site foreman. Covers programme status, payment milestones, the next thirty days’ activities and any variation orders raised or pending. You should be able to ask any question and get a direct answer rather than a deflection.
Planned against actual programme
A shared document showing planned and actual completion dates per stage, so delays become visible as they occur rather than at the end, when you had expected to move in.
Variation order transparency
Every scope change emailed as a written variation order with description, cost and reason before any work is executed. No verbal additions, and nothing left to be sorted at handover.
Payment milestone confirmation
You pay only after receiving the milestone photograph, the project manager’s written confirmation that the milestone is complete, and a payment request referencing the specific milestone in the BOQ contract. Three separate confirmations before money moves — which is what makes distance survivable.

Photograph, Written Confirmation, Milestone Reference — Then Payment
Milestone-triggered payment with independent verification at each release is the single mechanism that makes managing a build from another continent survivable.
The distance is not the problem. The absence of accountability systems is the problem.

Frequently Asked Questions
Can an NRI build a house in Chennai without visiting India?
Yes — by registering a Power of Attorney for an on-ground representative, appointing a COA-registered architect with an active TNOBPAS account for approvals, engaging a professional project manager for site supervision, and using milestone-triggered payment schedules with mandatory milestone photography before each payment is released.
What documents does an NRI need to build a house?
Current Patta in your name or the POA holder’s after mutation; registered Sale Deed; Chitta or A-Register extract; Encumbrance Certificate for the last fifteen years; approved layout plan where applicable; registered Power of Attorney; and a FEMA-compliant payment route via an NRO or NRE account with the correct purpose code.
What is a Power of Attorney for NRI construction?
A legal document authorising a named on-ground representative to sign contracts, engage professionals and deal with government authorities on your behalf. It must be notarised in your country of residence, apostilled for Hague Convention countries or consular-attested otherwise, and registered at the Sub-Registrar’s office in India. All three stages are required.
How can an NRI track construction progress remotely?
Milestone photographs with GPS tags at every stage; a monthly video call with the project manager rather than the site foreman; a shared construction programme showing planned against actual stage completion; written variation orders sent before any scope change is executed; and milestone payment confirmations from the PM before each payment is released.
How do NRIs pay for construction from abroad?
Payments must comply with FEMA. The standard route is remittance from an NRO or NRE account in India using the correct purpose code for construction. Confirm the process with your bank’s NRI desk before beginning — payments to personal accounts without FEMA guidance create tax and legal exposure.
How do I choose a reliable builder from overseas?
Verify the architect’s COA registration, an active Class 3 DSC and TNOBPAS account, references from two or three NRI clients specifically rather than residential clients generally, a full itemised BOQ before signing, a milestone payment schedule in the contract, a written variation order clause, and a named project manager with a direct contact number.
Is a Power of Attorney mandatory?
Not legally mandatory, but practically essential. Without one you must be physically present in India to sign the construction contract, the architect appointment and approval-related documents. Most NRIs cannot manage that reliably across a fourteen to eighteen month timeline, and a registered POA removes the constraint entirely.
What is the main risk in remote construction?
Information asymmetry between homeowner and contractor. Without milestone photographs, BOQ-based payment milestones, written variation orders and a named on-site project manager, the contractor controls all information about what was built and what was spent. A professional PM and a transparent BOQ-based contract are the primary mitigants.
Why does Patta mutation matter so much?
Because the building plan application will be rejected if the Patta does not match the applicant’s name. If you bought the plot but have not completed mutation at the Tahsildar’s office, start it before engaging the architect — it takes two to four weeks after application and can be initiated from overseas via the tnreginet.gov.in portal or through your POA holder.
Is professional project management worth the fee?
The fee typically runs 3–5% of the construction contract value, while the average documented overrun on self-managed remote projects without one runs 15–25% of the original BOQ. On those figures the margin is not close — and the fee generally pays for itself in the first variation order it prevents.
Documents Reviewed, FSI Confirmed, BOQ Produced — Before You Commit
We walk through your documents, confirm your plot’s applicable FSI and approval authority, and produce a preliminary BOQ. NRI projects managed across the US, UK, UAE, Singapore and Australia from a single Chennai base.
Systems, not proximity
NRI house construction in Chennai is entirely achievable from abroad with the right systems in place. Every element that makes it work — the full BOQ, milestone payments, written variation orders, progress photography, a named project manager and a written structural warranty — exists to create the accountability that makes remote construction tracking trustworthy rather than anxiety-inducing.
